Please note the boat will stay dockside for continuous boarding and will offer light appetizers and beverages. The entrance to the Creole Queen is at the Poydras Street dock at Spanish Plaza, located behind the Hilton New Orleans Riverside Hotel.

Tips for Standing Out to In-House Counsel as a Young Lawyer
Client service is foundational to private practice, and as outside counsel, we find ourselves frequently dealing with and answering to in-house counsel for our corporate clients. For young lawyers, standing out to your clients is essential to career progression. Please join us for an informal Q&A with a former litigator who now serves as in-house counsel in New Orleans, where we will discuss how young lawyers can best serve their corporate clients and receive tips on building effective client relationships.

Troubleshooting Ethics Problems While Working Remotely
One of the clearest lessons of the COVID-19 pandemic is that remote work is here to stay. While remote work expands our potential to serve our clients while maintaining a healthy work-life balance, it also presents potential pitfalls. This presentation will discuss frequently occurring ethics issues that arise in the course of remote work, from remote deposition practices to maintaining client privacy.

Dos and Don’ts of Effective Mediation Advocacy
Nearly every business litigation case will, at some point, proceed to mediation, but effective mediation advocacy and negotiation skills are often overlooked in training programs for young lawyers. This panel will focus on successful strategies throughout the mediation process, from preparation to presentation to the mediator to the negotiation itself. We will also discuss specific ways young lawyers can contribute to a successful mediation process even if they themselves are playing a supporting role.

Navigating Privilege Issues and Related Ethics Issues in the In-House Setting
In-house counsel face myriad privilege and ethical issues—some obvious and others obscured –in their daily practice. Judges often visualize in-house lawyers as wearing business rather than legal hats, company employees involve in-house lawyers for no discernable legal reason, and whether the privilege protects communications with affiliates generates questions of the attorney-client relationship and the unauthorized practice of law. This panel discussion with lawyers on the frontlines of these issues will identify and offer practical solutions for in-house lawyers—and the outside counsel with whom they work.

Hold onto Your Trade Secrets: The Winds of Change are Howling Around Employee Noncompete Agreements
Nearly sixty percent of employees who change jobs admit to stealing trade secrets on their way out the door. The harm to the economy and innovation caused by the misappropriation is so great that it led to the near unanimous passage of the Defend Trade Secrets Act of 2016, establishing a federal private right of action for trade secret misappropriation. Yet, in the name of enhancing employee mobility, the key agreements designed to protect trade secrets — employee noncompete and nondisclosure agreements — are under attack in legislatures across the country, in Congress, and at the Federal Trade Commission. This presentation will explore this dilemma and the steps companies can take to protect their trade secrets in the face of recent and anticipated regulation favoring employee mobility over the protection of trade secrets.

Maximizing Voir Dire in IP Cases
Intellectual property cases require special voir dire skills due to the complexities of the case issues and the jurors’ unfamiliarity with them. This seminar will review best practices for jury selection to maximize time constraints and other factors. Tips for asking the right questions, to learn as much as possible from the venire members, will be discussed. The seminar is designed to be interactive; questions from attendees are encouraged.

What You Need to Know about the Copyright Claims Board, the First Small Claims Copyright Tribunal in the US, Including When You Should Not opt Out of CCB Claims
If you’ve received a claim that was filed against your client in the Copyright Claims Board (CCB), you probably have a lot of questions, starting with “What is this, and what do I do now?” In short, the CCB is a voluntary forum housed in the U.S. Copyright Office to resolve copyright disputes involving claims up to $30,000 and is a new alternative to federal court. So, what should you do? Participating in a CCB proceeding is voluntary, and both parties must agree to participate; however, there are important benefits you should consider when deciding whether to participate, including cost, time, and experienced decision makers. Suzy Wilson, General Counsel and Associate Register of the Copyright Office, will discuss these benefits and more, as well as the circumstances when the CCB may not be the right tribunal for your client.

Ethical Internal Investigations: A Data Breach Case Study
Although many internal investigations are conducted quietly, ethical considerations cannot die in darkness. Devising a strategy to address potential ethical issues minimizes client risk and bolsters the investigation's credibility. Critically, all counsel must be mindful of future court or regulatory scrutiny, and in-house counsel must especially consider whether their dual role jeopardizes the attorney-client privilege or vitiates the work product doctrine. This presentation will use a data breach as a case study and discuss best practices in handling domestic and international internal investigations; highlighting recent case law to help counsel avoid potential pitfalls and becoming the next cautionary tale.
