    Hot Topics in Medical Device Preemption

    If you think you know everything about medical device preemption, think again! Medical device preemption differs significantly from drug preemption, because devices, unlike drugs, are subject to an express-preemption provision, 21 U.S.C. § 360k(a). Notwithstanding Lohr and Riegel, the two Supreme Court decisions interpreting § 360k(a), the scope of express preemption in the device world remains disputed terrain, with plaintiffs constantly generating new theories in an effort to avoid § 360k(a). Plus, don’t forget implied preemption, which can be applied in device cases, and recent drug cases, which can inform device cases as well. Register now to learn helpful practice tips.
