In today’s multicultural workplaces, employers are frequently faced with questions of whether an employee’s dress or office decorations infringe on religious accommodation issues. May an employee display a crèche on his or her desk during the holidays? Is it permissible to ask an applicant who is dressed in traditional religious clothing whether he or she can safely work in a manufacturing environment? In Bell Atlantic, Inc. v. Twombly, 127 S. Ct. 1955 (2007), the United States
Supreme Court arguably redefined the standard for pleading under FRCP 8(a)
(2) by holding that a plaintiff’s obligation to provide the “grounds” of his or her
“entitle[ment] to relief” requires more than labels and conclusions, and that formulaic
recitation of a cause of action’s elements simply will not do. This webconference
will feature a discussion of the background and key holdings from Twombly, followed by a panel discussion including speakers from product liability, commercial litigation and insurance law areas on using Twombly as a sword and how best to wield it in those and other substantive practice areas.
